ActiveDen and Activetuts – New Names, Same Awesome Content

Oct 19th in General by Collis Ta'eed

For just over three fantastic years FlashDen has been the jewel in Envato’s crown. It is our longest running and most active community, and thanks to the amazing authors who showcase their work there, has become the largest marketplace for Adobe Flash files in the world with over 8,500 items for sale.

Last week Adobe asked us to change our name and URL so that it would no longer contain the term ‘Flash’, which is a registered trademark of Adobe. We know that the success of our sites is about the community and content, not the names. So here at Envato HQ we’ve been busy thinking up new names and we think we’ve found a great new home for both our marketplace and our Tuts+ blog on Flash.

As of today the two sites now live at ActiveDen and Activetuts+.

But seriously, the new name is good, but im disappointed in Adobe, I think its incredibly petty and its not like the word “flash” is as specific as a trademark like “microsoft”.

I thought Adobe had more important things to do like ensuring the CS5 sales arnt as big of a flop as the CS4 sales.

Though I, too, think it was an asshole move by Adobe, in this case the word Flash was specific as it was related to it’s Flash technology. It wasn’t a randomly generated word by Envato to name their tut site and marketplace and they both accidentally happened to pertain to Adobe’s Flash product. An asshole move, but I understand why they did it. Now, I wonder if Adobe will start going after sites like FlashKit for the same thing.

That is one weird move against a site who successfully promotes flash content (ooops trademark), and especially in these days when we have Silverlight knocking on the door waiting to get in on the action.

Think this is pretty stupid, Envato builds up a name for themselfs, for 3 years long!
And Adobe just comes along thinking, “You guys are getting to big, and using the word Flash, let’s force them to change it..”. There are allot of other domains using the word “Flash”, but you don’t see Adobe asking them to change it..

If Adobe aren’t seen to be defending their trademarks then they can lose them. If someone tries to use Flash in an attempt to gain credibility then Adobe face a difficult situation if one site is already using a trademark of theirs.

I imagine their lawyers have instructed them to do it so a situation like that doesn’t occur, I don’t think that they would be hostile about the situation.

Its funny, cause the name Flash emphasizes the content of the site thus supporting a more lively eco system of people using flash, which in the end means more buyers of Adobe products.

Now, the name has change to something more generic allowing more different types of files, even flash competitor files(which is positive for us ofc.) but hurts Adobe Flash promotion.

And it didnt hurt for 3 years, what difference does it make now? There aren’t even any reasonable arguments for asking them to change, unless there is something we havent been told :)

Ah, another fine example of the regressive stubbornness of a company out of touch with their customers.

Ok, Adobe might be less “out of touch” with their customers than some of their competitors, but still…

If it was in FlashDen’s interest you could state that “flash” is that widely and commonly used that it’s public. Just like Apple claimed the word “podcast”. You need a bunch of people willing to defend this though, picking a new name is the easy option. I like the new name, but I do think that you’re known by your name. Non-frequent users will struggle.

I think some of your prices listed are a bit wrong, XML Countdown says $40, bu it’s only $6 on the site.

As far as I know even Adobe can not protect the word “Flash” – but “Adobe Flash” they can protect. But you did not use “Adobe Flash” in your domain name but “FlashDen”.

I disagree that Adobe is right to force you to change the name of your product but I guess it just cost too much (energy and money) to fight against it.

Too many “buts”, so shame on you Adobe …

Yeah you shouldnt be so eager to give it up, I doubt Adobe would do anything about it.

I say you put Silverlight sections on there to say F YOU to flash.

Seems its one of two things.

    1) Envato are push overs when it comes to their business pride. I mean c’mon dudes, they ask you to change your name (WHY!!!!!!!!!!) that you spent time building up. (where’s your compensation)?

    2) Adobe are planning to change the name of their product to something else and are telling insider people before the rest of us.

either way I think something is def up and needs to be sorted. I have flash in my domain and ill be dammed if I am changing mine. I’ll slap them with a wet sock if they ask.

Envato, you should register word “dobe” as your trademark and tell Adobe to remove it from their domain :)

You made the right decision. You guys also handled the ‘damage control’ of messages, emails, and the url change extremely quickly and effectively. It just goes to show how much heart Envato has.

I agree with the guys on TechCrunch, dick move on Adobe’s part.

There are no dumb questions: only dumb people :-)
“Den” is a place where foxes live.
      That’s why there’s a fox’s tail in the logo

I also had a domain name with the word “Photoshop” in it. Adobe asked me to either transfer the domain name to them or change our name. I had no choice but changed my domain name to something more generic. It hurts, I know. But things will be better for Envato.

It is a smart choice rather than fighting with them. That time should be spent on developing your site content instead of fighting pointlessly.

So if I wanted to build a website for mmm I don’t know let’s say only the greatest movie of all times Flash Gordon I would get shot down by Adobe® dream team of lawyers, very un-cool Adobe®.

If anything Envato™ has built a community around the Adobe® Flash® brand free of charge, do you know how much companies pay for a marking service that does just this? Large companies like Adobe® spend Tens of millions each year on building communities around their brands, Adobe® actions in this case makes no scents what so ever. If anything Envato™ should be charging Adobe® for this service they have gotten for the past 3 years!

No, it doesn’t work that way. If you made a Flash Gordon site, you’d probably hear from DC Comics, not Adobe. They are only getting after FlashDen/Tuts because in that case Flash pertains to their Flash technology. Your Flash Gordon site doesn’t tread on Adobe Flash’s waters at all. Though, again, DC Comics might have something to say about it.

I thought trademark infringement only occurred when your products confuse people from the real one. FlashDen wasn’t trying to confuse anyone. I guess just a concession by envato because they want to spend their time developing a community than defending an adobe onslaught. (That they would have eventually won…)

Confusion is not the only thing that governs trademark and copyright infringement. If that is your understanding, and either are in the business or are aspiring to be, I would highly suggest you read up on the subject. Having this knowledge will protect you in the future either from litigation or if someone rips from you. It works both ways and is very very valuable knowledge to have. :)

April 2010 i hear is the launch date for CS5? They are risking falling flat on their face’s again as not everybody can afford this!
